User Agreement

Last updated: October 29, 2026

1. Parties

This agreement is made between Test (the "Platform") and the person or entity that signs up to use its e-commerce software (the "User") when the User accepts it electronically.

2. Definitions

  • Service: the store software, admin panel, hosting, domain connection, integrations and the other software services of the plan.
  • Store: the online shop the User runs with the Service.
  • Buyer: a person who buys from the Store.
  • Plan: the subscription described on the pricing page.
  • Third-party service: payment, shipping, e-invoice and other services the User connects with their own account.

3. Subject

This agreement sets the terms of use of the Service and the rights and obligations of the parties. The Platform is not the seller of what the Store sells; the sales contract is between the User and the Buyer.

4. Rights and obligations

The User keeps the account details accurate and up to date and the account secure, publishes the seller disclosures the law requires, complies with consumer and distance sales law, is responsible towards Buyers as the seller and meets its tax obligations. The Platform provides the Service with reasonable availability, announces planned maintenance in advance and takes the technical and organisational measures needed to keep the Service secure.

5. Prohibited products and content

Illegal or counterfeit goods, infringing content, licensed goods sold without a licence, misleading advertising, content against the Acceptable Use Policy; removal, suspension and termination.

The Platform is a hosting provider under Law No. 5651 and an intermediary service provider under Law No. 6563. It does not review the User's content in advance; it acts on notices of illegal content within the legal deadlines and keeps access records for the period the law requires.

7. Fees and payment

Plan fees, the billing period and the renewal terms are shown on the pricing page and on the purchase screen. The Service may be restricted for a period that is not paid. Price changes are announced before they take effect. The Pre-contractual Information Form and the Distance Service Contract are accepted separately when a plan is bought.

8. Intellectual property

Software, design and trade marks belong to the Platform; the Store's content and data belong to the User, who grants the Platform the rights needed to provide the Service.

9. Security

Passwords and two-step verification, reporting unauthorised access, the Platform's security measures and incident notices.

10. Limitation of liability

Indirect damages, third-party outages, force majeure, liability cap.

11. Personal data

For the data of the Store's Buyers and visitors the User is the controller and the Platform the processor, as set out in the Data Processing Agreement. The User's own personal data is processed as described in the Privacy Notice.

12. Term and termination

Indefinite term; the User may close the account or the Store in the panel; termination for serious breach; data export and statutory retention.

13. Confidentiality

Business information learned under this agreement stays confidential, also after it ends.

14. Changes and notices

The Platform may change this agreement. Changes are announced by e-mail and in the panel; for material changes the User accepts the current text again when signing in. Notices go to the e-mail address of the account.

15. Evidence

In a dispute the Platform's electronic records (consent records with the accepted version, time, IP address and source port) are evidence under article 193 of the Code of Civil Procedure.

16. Governing law and jurisdiction

Turkish law applies. For consumer transactions the Consumer Arbitration Committees and Consumer Courts, otherwise the courts and enforcement offices of the service provider's registered seat, have jurisdiction.

17. Entry into force

This agreement enters into force when the User accepts it electronically.
